 Introduction to Jordanian Commercial Law

Under the 1994 amendments to the Jordanian constitution, a new section was added to Article 97, which states: “The Judiciary is an independent authority and is responsible for applying the laws, protecting rights, freedoms and ensuring justice. The Judiciary shall, in particular, undertake its discretionary competence without subjugation to any authority.” The judicial branch of the government is made independent of the executive and legislative branches. This section also prohibits the government from interfering in the judicial domain. Jordan is not unique in making the judiciary independent. All Arab countries have made efforts, with various degrees of success, to make the judiciary independent of the executive and legislative branches of government.
